Legislation

In order to reduce the pollution of our environment it is important that organisations comply with key environmental regulations. Failure to do so could result in prosecution. All industrial, commercial or institutional sites storing, externally, oil in 205 litre drums, intermediate bulk containers (IBC’s) or fixed tanks must comply with the following regulations:

  • In England and Wales-Control of Pollution (Oil Storage) (England) 2001
  • In Scotland-The Water Environment (Oil Storage) (Scotland) 2006

In England the Environment Agency (EA) has the duty of enforcing these regulations. If you do not comply the EA "may take legal action for non-compliance and could serve a notice to make you bring the facilities up to standard. Failure to comply with this notice would be a criminal offence and may result in prosecution."(Environmental Agency). Spill Kits Direct products can assist you to comply with environmental legislation and guidelines.

The EA have devised many Pollution Prevention Guidelines, for example, with regards to "DEALING WITH OIL SPILLS; You should introduce measures to control any oil spills that occur on your site. Have a pollution incident response procedure for dealing with spills. Make sure that all staff are familiar with this procedure and how to implement it". "Keep a spill kit and absorbent materials near to your oil store so that you can access them easily when they are needed."

Please take the time to familiarise yourself with the important EA Pollution Prevention Guidance Notes (PPGs). Included below are links to some of the relevant PPG’s.
